These terms and conditions ("Terms") apply to the Batchelor’s and DC Bestway promotion for a chance to win a Batman experience in Paris for two (the "Promotion"). By participating in the Promotion, you will be legally bound by these Terms. Promotional materials relating to the Promotion, including all information on how to enter the Promotion also form part of these Terms. If there is a conflict in these Terms with any such promotional materials or any other terms whatsoever attached to any other advertising material in respect of the Promotion, these Terms will take precedence. The Promoter
1. Premier Foods Group Limited of Premier House, Centrium Business Park Griffiths Way, St. Albans, United Kingdom, AL1 2RE and Bestway Wholesale Limited of 2 Abbey Road, London, NW10 7BW (the “Wholesaler”) are each a “Promoter”.
Eligibility
2. The Promotion is open to residents of Great Britain, aged 18 or over, who have an account with the Wholesaler (each an “Eligible Retailer”). References in these Terms to “Eligible Retailer” and “participant”, respectively, refer to the individual taking part in this Promotion. The Promotion is not open to employees, contractors, representatives, agents, officers or directors of the Promoters, respectively or, their respective parent companies, subsidiaries, affiliates, marketing agencies or, to any of their respective immediate family members or any persons living in the same household, whether or not related, or to anyone else professionally connected with the Promotion.
3. The Promoter(s) reserve the right to verify the eligibility of any participant or claimant of a prize. A Promoter may require such information as it considers reasonably necessary for this purpose, which may include proof of purchase, identity, age, residency and address. The Promoter(s) may withhold prizes while it verifies eligibility.
How to Enter
4. The Promotion will begin at 00.00 (UK time) on 3 January 2025 (the “Opening Time”) and will close at 23.59 (UK time) on 27 February 2025 (the “Closing Time”). The period from and including the Opening Time and ending at and, including the Closing Time is the “Promotion Period”.
5. Eligible Retailers who purchase a minimum of three cases of any combination of the “Qualifying Products” listed in Appendix 1 to these Terms, at a Bestway depot or online at https://www.bestwaywholesale.co.uk, in a single transaction (a “Qualifying Purchase”), will automatically receive an entry into the prize draw. Eligible Retailers will receive one entry into prize draw, for each Qualifying Purchase made. Please retain proof of Qualifying Purchase, as this may be required to validate your entry and any claim to any prize won.
6. Only Qualifying Purchases made during the Promotion Period will generate entries into the Promotion.
7. Qualifying Products are subject to availability.
Selection of winners and the prize
8. Eligible Retailers will receive an entry, per Qualifying Purchase, into a prize draw for a chance to win a Batman experience in Paris for two people (the “prize”). The prize includes:
- a one night stay for two people, in a 4 star hotel, in La Vilette in Paris. Guests will share a standard double room. Breakfast is included;
- Return economy flights from to Paris from either Manchester, Edinburgh, Belfast or select London airports (flights may be indirect) or alternatively, travel via Eurostar (economy class) from London St Pancras (mode of transport will be at the Promoter’s discretion);
- standard admission tickets to the Batman Batcave escape room experience in Paris (escape room experience lasts approximately 70 mins. Not suitable for children under 7 years of age). Terms and conditions apply, see: https://batman-escape.com ;
- a 24-hour “hop on and hop off” bus tour pass;
- basic cover insurance (excludes pre-existing conditions. Maximum age for cover is 75 years. Other restrictions may apply; please contact digital@bestway.co.uk if you have any queries. Alternatively, the Promoter(s) or the prize fulfilment agency can provide further details when arranging booking of your prize. The winner and their guest will be responsible, at their cost, for arranging insurance cover for any coverage not provided by the basis insurance cover.
9. The prize must be booked on a weekend (date of travel being a Friday, Saturday or Sunday), falling within the period from 10 May 2025 to 31 August 2025. Other prize terms and restrictions apply, see “General Prize Terms” below.
10. Within four (4) weeks of the Closing Time, one (1) winner will be selected at random from all valid entries received into the prize draw in accordance with clause 5, to win the prize.
General prize terms
11. The prize must be booked, taken and completed before the prize validity period expires. All elements of a prize must be taken at the same time and winner and their guest must travel together. Dates and times for booking prizes (including accommodation and any experiences included within the prize package) are subject to availability. Bank holidays in the UK and any destination of travel are excluded. The winner should aim to provide the Promoter(s) or the prize fulfilment agency with as much notice as possible, ahead of their desired date for utilizing their prize, to avoid disappointment.
12. At least one person travelling must be aged 18 or over. Any guests travelling who are under 18 must only do so with the permission of a parent or legal guardian.
13. Prizes to ticketed events are subject to and must be used in accordance with the terms and conditions of the ticketed event. Unless specified otherwise in the prize description, experience or ticketed event prizes are general admission only; certain experiences or attractions may include certain optional additional activities, not included within general admission access and which may be charged for separately. If taken, these costs will be the responsibility of the winner and their guest.
14. Lost or stolen tickets cannot be replaced.
15. Unless expressly included within the description of the prize, insurance, travel expenses, tax, personal and food and drink expenses are excluded. Any costs incurred in addition to those included within the prize and that are incidental to the fulfilment of the prize are the responsibility of the winner and their guest.
16. A valid credit or debit card will be required upon check-in to cover any incidentals or, for the purpose of covering any damage to the accommodation caused by the winner or their guest.
17. Winners will be responsible for ensuring that they and any person travelling with them are available to travel and hold valid passports, any necessary visas and travel documents (including insurance) for the holiday in question on the travel dates specified. Dates once notified to the Promoter(s) or prize fulfilment agency, as applicable, cannot be changed. Winners and guests are responsible for ensuring that they have all appropriate vaccinations (if necessary) and comply with health regulations. Winners and guests must comply with the applicable laws and regulations in the destination of travel and, with any terms and conditions of any carrier, airline, provider of accommodation, event or experience.
18. Prizes cannot be sold, transferred or auctioned. Prizes are non-transferable and non- refundable. There is no cash or other alternative, except in circumstances outside the Promoter’s(s’) control, where the Promoter(s) has the discretion to replace the prize with an alternative of equal or higher value.
Winner Announcement and Delivery of the prize
19. Winners of the Promotion will be contacted by the Wholesaler via the telephone number and / or email address registered with their Bestway account, within four (4) weeks of the Closing Time (the “Notification Date”). Eligible Retailers who have not won a prize will not be notified. Wholesalers will make reasonable efforts to contact winners (at least three communication attempts via phone and / or email). Eligible Retailers will be provided with details on how to arrange the booking of their prize with the Wholesaler, upon notification in this clause 19.
20. A winner forfeits their prize, and the Promoter(s) reserves the right to select at random, an alternative winner from all eligible entries received if:
(a) the Wholesaler is unable to contact the winner in accordance with clause 19;
(b) the Wholesaler makes reasonable attempts to book the prize for the winner but is unable to find a date suitable for the winner, having exhausted all available date options within scope of the prize package or, is unable to liaise with the winner to arrange booking of their prize having made reasonable attempts (and reasonable attempts, shall mean at least four communication attempts via phone and / or email);
(c) a prize is rejected or returned undeliverables;
(d) a winner cannot accept the prize for any reason; or
(e) an entry is invalid or a participant is disqualified or in breach of these Terms.
21. Where prizes are delivered by post, the winner or, an individual aged 18 or over nominated by the winner, will be required to be available at the nominated delivery address to accept and sign for delivery of the prize.
22. It is the responsibility of the Eligible Retailer to provide accurate, up-to-date details. The Promoter(s) cannot be held responsible for Eligible Retailers failing to supply accurate information which then affects the acceptance or fulfillment of their prize. The Promoter(s) does not accept any responsibility for any inability of an Eligible Retailer to take up the prize.
Data Protection and Marketing
23. Any personal information of participants that is used or shared in connection with this Promotion (including name, address email, or other data) will be kept secure and only used in line with these Terms and the Wholesaler’s Privacy Policy at: www.bestwaywholesale.co.uk/privacy-policy. By entering this Promotion, the participants acknowledge that any personal data held on their Bestway account shall be used by the Promoter(s) or their respective agents, for the purpose of administering this Promotion. The Promoters are bound by, and will use your data in accordance with, the General Data Protection Regulation 2016/679 and the Data Protection Act (2018).
24. In entering the Promotion, all participants agree that any winners may be required to participate in any promotional activity or advertising relating to the Promotion, which may include entry content, voice, image and name for publicity purposes (in any media, print or online, including any websites, social media sites or third party retailer websites) and in advertising, marketing or promotional material (whether or not related to the Promotion) free of charge without additional compensation or prior notice. Promoter(s) may modify any entry content to fit in context with the relevant usage, whilst maintaining its original sentiment. The Promoter(s) must either publish or make available information that indicates that a valid award for the Promotion took place. The Promoter(s) may therefore use the winner’s surname and county of residence to announce them as the winner of the Promotion. If you do not wish for your personal information to be used for this purpose or, if you wish to limit the amount of personal information that is published, please contact: dataprotection@bestway.co.uk. The Promoter(s) must still provide such information and all winning entries to a UK regulator, such as Advertising Standards Authority, on request.
25. To receive a list of winner(s) and county of residence of the winner(s) please contact: digital@bestway.co.uk within 3 months of the Closing Time. Please note this information may not be disclosed if a participant objects to the disclosure of such information in accordance with clause 24. Where a winning participant has objected to their information being disclosed, the Promoter(s) will instead confirm that a valid award has taken place. The Promoter(s) must still disclose the information to UK regulators, such as the Advertising Standards Authority, on request.
Limitation of Liability
26. Insofar as is permitted by law, neither of the Promoters, nor their respective agents, suppliers or distributors involved in this Promotion, will be, under any circumstances responsible or liable to compensate the winners, whether arising from tort including negligence, breach of contract or otherwise, or for any loss, damage, loss, liability, injury or personal disappointment incurred or suffered whatsoever as a result of or relating to participation in this Promotion or the prizes, unless you suffer personal injury or death as a result of the negligence of a Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
27. By participating in the Promotion, Eligible Retailers agree to release and hold harmless Warner Bros. Discovery and its related companies, and its respective officers, directors, employees, and agents from and against any claim or cause of action arising out of its participation in the Promotion or receipt or use of any prize.
28. Neither of the Promoters, not their respective brands, nor this Promotion is endorsed by any third-party provider of prizes. Participants agree that such third parties shall be released from all liability and any claim or cause of action arising as a result of the participant’s participation in the Promotion or, receipt of the prize. This does not affect your statutory rights.
General
29. By entering the Promotion, you are agreeing to be bound by (i) these Terms and, to the extent applicable, the terms available on Bestway’s website: https://www.bestwaywholesale.co.uk. Any entries that do not comply in full with these Terms and the applicable terms set out in this clause will be disqualified.
30. Entries and claims for prizes which do not include all of the information required, will be deemed as invalid.
31. Any decision of the Promoter(s) as to eligibility to take part in the Promotion or the result of the Promotion will be final, and no correspondence or discussion will be entered into.
32. The Promoter(s) reserves the right to refuse any entry, claim or award of prizes and/or refuse further participation in the Promotion and disqualify a participant or winner where it believes there has been a breach of these Terms, the spirit of the Promotion, any instructions forming part of this Promotion's entry requirements or otherwise where a participant has gained unfair advantage in participating or claimed using fraudulent means. Promoter(s) also reserves the right to disqualify any participant or winner that in its absolute discretion could bring the Promoter(s) into disrepute. The Promoter’s(s’) decision will be final in this regard.
33. The Promoter(s) does not accept any responsibility for entries that are late, delayed, incomplete, illegal, misdirected, lost, damaged, incorrectly submitted, are unreadable or misdirected, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure, non-availability of the website, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind, or any other reason.
34. The Promoter(s) does not accept any responsibility or liability for (a) any codes, entries or notifications which are not received due to the use of incorrect or inaccurate entry information, any faulty or failed electronic data transmissions, or for any other reason; (b) any unauthorised access to, or theft, destruction or alteration of entries at any point in the operation of the Promotion; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers used in any aspect of the operation of the Promotion; (d) inaccessibility or unavailability of any network or wireless service, the internet and/or any website; or (e) any injury or damage to any person’s computer(s) or mobile device(s) which may be related to or result from any attempt to participate in the Promotion or to download any materials in connection with the Promotion.
35. The Promoter(s) reserves the right in its absolute discretion to amend or waive any of these Terms, or to delay, postpone or cancel the Promotion at any stage, in the event of circumstances that are unforeseen or outside its reasonable control, which it considers necessary (including suspected or actual fraudulent or misleading practices or other breaches of these Terms).
36. The Promotion and these Terms are subject the laws of England and Wales. Any disputes must be referred to the English courts.
